1. Acceptance and scope
By accessing upnabout.com or using its interactive prototype, you agree to these terms. If you do not agree, do not use the website or demo.
These terms apply only to the website and prototype as available on August 3, 2026. They do not create an account, subscription, monitoring relationship, medical relationship or emergency-response agreement.
2. The demo is a simulation
The browser demo uses fictional sample people, addresses, phone numbers, check-ins and alerts. It is provided to explain a proposed product experience.
Actions in the demo—including “I’m okay,” “Call Margaret,” emergency help, invitations and settings—do not send, store or trigger real-world actions. Do not enter genuine medical details, access codes, addresses or other sensitive information.
3. Not an emergency or medical service
Up & About is not an emergency response service, professional monitoring service, medical device or provider of medical advice. The website and prototype cannot detect an emergency, contact your circle or dispatch assistance.
If you believe someone may be in immediate danger, contact the emergency services for their location immediately. Do not wait for or rely on this website. Read the full safety and emergency-services statement.
4. Acceptable use
You may explore the website and prototype for personal, informational and evaluation purposes. You must not:
- attempt to disrupt, overload, bypass or compromise the website or its security;
- use automated access in a way that harms availability;
- misrepresent the prototype as an operational emergency service;
- copy or use the service in a way that infringes rights or violates law; or
- use the website to threaten, deceive or harm another person.
5. Content and ownership
The Up & About name, product presentation, original text, interface and other site materials are owned by or licensed to the site operator, except where a third-party credit is shown. These terms do not transfer ownership or grant permission to reuse branding or substantial site content.
You may link to public pages and quote brief portions for commentary or reporting with appropriate attribution.
6. Third-party services and links
The website may load resources from or link to third parties. Those services operate under their own terms and privacy practices. A link does not imply endorsement, and Up & About is not responsible for third-party availability or content.
7. Availability and disclaimers
The website and prototype are provided on an “as available” basis for pre-release evaluation. Features, wording and availability may change or be withdrawn. Although reasonable care is taken, the site may contain errors or interruptions.
To the extent permitted by applicable law, the operator does not promise that the website will be uninterrupted, error-free or suitable for reliance in safety-critical decisions. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.
8. Governing law
These website terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Any dispute relating to the current website or prototype will be brought in an appropriate state or federal court located in New York County, New York, unless applicable consumer law requires otherwise.
Nothing in this section removes rights that cannot be waived under the law that applies to you.
9. Changes to these terms
These terms may be updated as the product develops. The date on this page will change when material revisions are published. Continued use after an update means the revised website terms apply from that point onward.
Last updated: August 3, 2026.
10. Operator details
The pre-release website is operated by Chris Kerger, founder of Up & About, based in New York City, New York, United States.
Questions about these terms may be sent to info@upnabout.com. Final product terms will be published before accounts, payments or operational alerts are offered.
